2.1 Who we are
Pink Aubergine Branded Bakes is a UK-based bakery specialising in bespoke, branded and made-to-order cakes, cupcakes, biscuits and bakes. Our registered address is 1 Clappentail Park, Dorset DT7 3NB.

3. Our Contract With You
3.1 Order acceptance
Your order is accepted when you receive an order confirmation email from us or accept a quotation and receive and invoice. A legally binding contract is formed at this point.
3.2 If we cannot accept your order
If we are unable to fulfil your order due to circumstances beyond our control or incorrect information supplied by you, we will contact you and, where appropriate, arrange a refund.
3.3 Order details
Please check your order confirmation carefully. It is your responsibility to notify us promptly of any errors.
4. Products
4.1 Product images and descriptions
Images on our website are for illustrative purposes only. As all products are handmade, slight variations in colour, size and finish may occur.
4.2 Branded and bespoke products
Where you provide logos, images or text, we will reproduce them as accurately as possible. Due to the nature of edible printing and handmade products, exact colour matching or identical reproduction cannot be guaranteed.
4.3 Allergens
All products are made in a kitchen that handles all common allergens. While we provide allergen information, we cannot guarantee products are free from cross-contamination. Please contact us before ordering if you have any concerns.
5. Pricing and Payment
5.1 Prices
All prices are shown in GBP and are subject to change. The price payable is confirmed at checkout or on your bespoke quotation.
5.2 Payment
Payment is required in full before production or dispatch unless otherwise agreed in writing. All invoiced orders require payment within 30 days of invoice date.
5.3 Corporate and bespoke orders
Corporate or bespoke orders may require a deposit. Details will be confirmed as part of your quotation.
6. Delivery
6.1 Delivery areas
We offer delivery throughout the UK, including Northern Ireland and the Channel Islands, using courier services. Some remote areas are excluded or carry an additional charge - please contact us for more detail.
6.2 Dispatch days
Orders are dispatched Monday to Friday for delivery Tuesday to Saturday. We do not dispatch on Sundays, Bank Holidays and occasional other dates - we will advise on ordering if your requested date is affected.
6.3 Delivery dates
Delivery dates are estimates and cannot be guaranteed. We are not responsible for delays caused by couriers or circumstances beyond our control.
6.4 Responsibility for delivery
Once your order has been handed to the courier, responsibility for delivery timings lies with the courier. We cannot be held liable for delays, missed deliveries or access issues at the delivery address.
6.5 Incorrect delivery information
You are responsible for providing accurate delivery details. We cannot accept responsibility for failed deliveries caused by incorrect or incomplete information.
6.6 Damaged deliveries
If your order arrives damaged, you must notify us within 24 hours of receipt and provide photographs of the damage and packaging so we can investigate.
7. Cancellations, Refunds and Returns
7.1 Cancellations
As our products are made to order and often personalised, cancellations may not be possible once production has begun. Where baking, decorating or printed elements have started, refunds may be partial or unavailable.
7.2 Refunds
Refunds will be considered on a case-by-case basis and processed within a reasonable timeframe once agreed.
7.3 Perishable goods
Due to the perishable nature of our products, we cannot accept returns unless goods are faulty or damaged.
8. Intellectual Property and Content
8.1 Your content
You confirm that you own or have permission to use any logos, images or text supplied to us and that they do not infringe third-party rights.
8.2 Licence
By supplying content, you grant us a non-exclusive licence to reproduce it solely for the purpose of fulfilling your order and for portfolio or marketing use unless you request otherwise.
8.3 Refusal of content
We reserve the right to refuse to reproduce any content we consider offensive, unlawful or inappropriate.
9. Data Protection
We process personal data in accordance with UK data protection legislation. Please see our Privacy Policy for full details.
10. Liability – Business Customers
If you are ordering as a business, our liability is limited to the value of the products supplied. We are not liable for indirect or consequential losses, including loss of profit or reputation.
11. Liability – Consumers
Nothing in these terms limits your statutory rights as a consumer. We are responsible for foreseeable loss or damage caused by our failure to use reasonable care and skill.
12. Force Majeure
We are not liable for delays or failure to perform our obligations due to events beyond our reasonable control, including severe weather, courier disruption or supply issues.
13. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
